1. Provider and scope

1.1 Traveto is operated by Kilo Moana UG (haftungsbeschränkt), Heidestraße 49g, 25462 Rellingen, Germany, registered in the commercial register of the Pinneberg Local Court under HRB 19590, represented by its managing director Alexander Siemer-Schmetzke, email info@kilo-moana.com ("we").

1.2 These terms apply to the use of the Traveto application at app.traveto.app, the apps for Android, iOS and TV and the interface for AI assistants (together "Traveto"), and to paid subscriptions.

1.3 Terms of users that differ from these do not apply.

2. Services

2.1 Traveto is an application for planning trips together. Users collect places on maps (boards), organise them, plan vacations and stages, keep to-dos and packing lists, and share boards with others.

2.2 Free account. With a free account, users can view boards they are invited to, work in boards whose owner has a subscription, and create one board of their own.

2.3 Subscriptions. Users who want to use their own boards to the full extent need a subscription. There are the plans Expedition and Atlas. Their scope, in particular the number of own boards and the daily or monthly limits for new places, map searches and AI features, is shown on the subscription page of the application before purchase. This information is part of the contract.

2.4 Third-party data. Place data such as address, rating and photos comes partly from Google, holiday dates from the OpenHolidays API, maps from OpenStreetMap. We do not guarantee that this data is correct or available.

2.5 AI features. Suggestions, assessments, packing suggestions and summaries are generated by an AI model. They may be incomplete or wrong and do not replace your own checks, for example of opening hours, entry requirements or bookings. Traveto is not a booking platform.

2.6 AI assistants. Users can connect Traveto to an AI assistant from another provider (such as Claude or ChatGPT). The assistant then acts in the user's name and with the user's permissions. Whatever the assistant changes in Traveto on the user's instruction counts as an action of the user. The assistant itself is governed by its provider's terms.

2.7 We continue to develop Traveto and may change features, provided that the agreed scope of a running subscription is not significantly reduced. We aim for high availability but do not owe any particular level; we announce maintenance where possible.

3. Account

3.1 Using Traveto requires an account with a valid email address. Users must be at least 16 years old. Only users of full age can take out a subscription.

3.2 Login details must be kept secret. Anyone who notices misuse informs us.

3.3 Users can delete their account in the application at any time. We then cancel a running subscription at the end of the paid period; nothing more is charged. The account is finally deleted 30 days after the request; a subscription still running at that time ends with it.

4. Conclusion of a subscription contract

4.1 The user chooses a plan and a billing period (monthly or yearly) on the subscription page, checks the details on the payment page of our payment provider Stripe and completes the order with the button for taking out the subscription on that payment page. In doing so, the user makes a binding offer, which we accept by activating the plan.

4.2 We do not store the contract text separately; these terms are always available at traveto.app/agb. The contract language is German or English.

5. Prices and payment

5.1 The prices shown on the subscription page at the time of the order apply. All prices include statutory VAT. Currently Expedition costs €7.90 per month or €79 per year, Atlas €14.90 per month or €149 per year.

5.2 The price is due at the beginning of each billing period and is collected via Stripe using the chosen payment method. Stripe issues an invoice on our behalf.

5.3 We change the price of a running subscription only with the user's consent. We ask for it in the application or by email at least six weeks before the billing period from which the new price is to apply. If the user does not consent, the subscription continues at the previous price; we may then cancel it at the end of the current billing period.

6. Term and cancellation

6.1 A monthly subscription runs for one month and renews by one month at a time unless cancelled. A yearly subscription initially runs for one year. After that it continues for an indefinite period and is still billed yearly in advance; the user can then cancel it at any time with one month's notice. We refund the amount already paid for the time after the end on a pro rata basis by days.

6.2 Otherwise the user can cancel at any time at the end of the current billing period, using the button Cancel contracts here in the menu and on the subscription page, or by email to info@kilo-moana.com. We confirm the cancellation by email immediately. The plan stays active until the end.

6.3 A subscription ends immediately only by withdrawal (section 10).

6.4 The right to extraordinary termination for good cause remains unaffected. Good cause for us is in particular a serious breach of section 7.

7. Obligations of users

7.1 Users only post content they are entitled to post and do not infringe the rights of third parties. They only enter personal data of others (for example in notes, comments or the travel profile) to the extent they are authorised to do so.

7.2 Prohibited in particular are unlawful, insulting or discriminatory content, spam, circumventing plan limits, automated mass queries outside the intended interfaces, and interference with the security of Traveto.

7.3 In case of violations we may remove content and block accounts. In doing so we take the legitimate interests of those affected into account and inform them where possible.

8. Content and rights

8.1 Content posted by users remains theirs. They grant us the simple rights we need to store the content, to show it to the members of the respective board and, after sharing, publicly, and to process it technically.

8.2 Place data from Google, map material and the application itself may only be used within Traveto.

9. Liability

9.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of a guarantee we have given.

9.2 For slightly negligent breach of an essential contractual obligation, that is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment users may regularly rely, liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded.

9.3 Users are responsible for backing up their own content to the extent it matters to them.

10. Right of withdrawal for consumers

Consumers have a right of withdrawal. The withdrawal information is shown on the subscription page before purchase and below in this section. Users can withdraw using the button Withdraw from contract in the menu and on the subscription page.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Kilo Moana UG (haftungsbeschränkt), Heidestraße 49g, 25462 Rellingen, Germany, phone +49 152 04744501, email info@kilo-moana.com) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory. You can also exercise your right of withdrawal online at app.traveto.app/widerrufen (in the app menu under "Withdraw from contract"). If you use this online function, we will send you an acknowledgement of receipt on a durable medium (for example by email) without delay, with information on the content of the withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient that you send your notice of exercising the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same means of payment you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

If you requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us that you are exercising the right of withdrawal with regard to this contract, compared with the total scope of the services provided for in the contract.

Compensation for value

If the user expressly requested before the purchase that we begin the service before the withdrawal period expires and then withdraws, the user pays a pro rata amount for the time until the withdrawal: amount paid × days used ÷ days of the billing period, rounded down to the cent. Days used are full calendar days from the start of the paid period to the day of withdrawal; on the day of purchase it is zero. Example: monthly subscription at €7.90, withdrawal after 10 of 30 days: compensation €2.63, refund €5.27.

11. Changes to these terms

11.1 Changed terms apply to a user only once the user consents to them. We ask for this consent in the application and state what changes.

11.2 Until the user consents, the application can only be used to a limited extent: the user can manage the account, cancel, withdraw and delete the account. If the user has a running subscription and does not consent, the user may terminate it extraordinarily; we refund the amount already paid for the time after that on a pro rata basis by days.

12. Final provisions

12.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.

12.2 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12.3 If any provision is invalid, the remaining provisions remain valid.
